Welcome to our website, which provides you an overview of our services and us. This document refers only to your use of the site and not of our services. We will provide you with those terms of use in our discussions with you about using our services.

This is a Binding Agreement
This Terms of Use (“Agreement” or “TOU”) is a binding agreement and governs your use of our website (the “Site”). You agree to these terms when you visit the Site. If you do not agree to the terms, then leave the Site. “You” means you, the site visitor and “we,” “us” and “our” refer to Yosemite Consulting, Inc. You must be over 13 years old.
Do you represent an organization?
The terms of this TOU apply to the organization for which you are working, or that has engaged you and you are searching as part of your job description of engagement.
How you can use the site
We obtain your personal information if you (i) sign up to request additional information; (ii) submit payment information; (iii) contact us about our services, our contract with you or other topics such as your use of our services, e.g., databases that you provide to us.
How Do We Use the Information We Receive?

You can use the Site to find out more about us or contact us. In the future, you might be able to download information we provide and identify as downloadable. You agree that you:

  • Will provide accurate contact information if you want us to get in touch with you
  • Will not do anything unlawful, misleading, or fraudulent
  • Will not violate this TOU
  • Will not interfere with how the Site functions
  • Will not use bots or other tech to post or collect anything including data or content
  • Will not sell, license, or purchase any content, accounts, features and functionalities
  • Will not violate applicable law in your visit to the Site or information you have obtained through such use
We will try to deliver interesting information

We provide truthful and accurate information about Yosemite Consulting and its team. We might from time-to-time post articles, blogposts, images or other content that we think would be useful for Site visitors. As persuasion advertising is based in many ways on qualitative factors, you might disagree with what is posted. We do not represent or warrant that such information posted is or will remain truthful or accurate and take no responsibility for use of it. In addition, we will try to use reasonable skill and care in keeping the Site up and running and error-free, but we cannot guarantee that it will always function without disruptions, delays, inaccuracies or other problems such as data transfer. 

Rights in Content
We own, or have rights to, all of the content and the look and feel of our Site (“Content”). We give you the right to access the Site and to view (and read) Content displayed on the Site but you cannot download it, copy it or otherwise use it, even if you create a derivative work, without our prior express and written approval of such use.
Limitations of liability

You accept the Site, and anything you find there or through there, “as is,” and we and our third party suppliers and licensors make no warranty as to its use, performance, or otherwise. To the maximum extent permitted by applicable law, we and our third party suppliers and licensors disclaim all other representations, warranties, and conditions, express, implied, statutory, or otherwise, including, but not limited to, implied warranties or conditions of merchantability, quality, fitness for a particular purpose, title, and non-infringement. The entire risk arising out of use remains with you.

Disclaimer of warranties

This limitation of liability is to the maximum extent permitted by applicable law. In no event shall we (or our third party suppliers and licensors) be liable for any costs of substitute products or services, or for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, or loss of business information) arising out of this Agreement or the use of or inability to use any part(s) of the Site or the failure to provide support services relating to the Site, even if we have been advised of the possibility of such damages. Our entire liability (and that of our third-party suppliers and licensors) arising out of this Agreement and your access to and use of the Site shall be limited to one hundred dollars ($100.00). In addition, our third party suppliers and licensors and we bear no liability for any technical inaccuracies or other errors, or for damages resulting from use of the information in any documentation.

The above does not exclude or limit our liability for any other things that the law does not permit us to exclude.

Please also note that this limitation of liability does not apply to your use of our services—just your visit to our Site. Your use of our services will be governed by a different agreement signed (digitally in many cases) by us and by you.

Changing the Site
From time to time we will change the features, functionality, Content and “look-and-feel” of the Site. As you will note in this Agreement, we have no liability whatsoever for the consequences of any such change.
Your feedback
We always appreciate feedback or other suggestions but we may use them without any restrictions or obligation to compensate you for them and we are under no obligation to keep them confidential.
How we will handle disputes
If a claim or dispute arises out of or relates to your visit to the Site, please email us the details to billing@yosemiteconsulting.com or we will notify you. Both you and we agree that California law governs all maters arising from your use of the Site, this Agreement or our relationship with you arising from it. You consent to the exclusive jurisdiction of state or federal courts in the City of Los Angeles, Los Angeles California and without regard to conflict of law provisions and case law.
Updating these terms
We will try to notify you of any changes to this Agreement before we make the changes unless we feel that it is important to make them as soon as practical, given the situation. When we do, your continued use of the Site (such as another visit) means you accept the changes to this Agreement. If you do not, you can contact us and you can stop using the Site.
Third party sites & information
There may be links on the Site that, if clicked, will probably take you to the sites of third parties. At that point, you will be leaving our Site and you might be subject to their terms of use and privacy policies and other documents. We have no control over these sites and the content there or any other use of such sites including other links on such sites.
If you believe your copyright is infringed

If you are a copyright owner or agent for the owner and believe that content found on our Site infringes your copyright, please submit a notice, pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512(c)) to our Copyright Agent with the information described below. Please remember that if it is content on one of the sites linked to our Site, then do not send any notice to us.

Copyright infringement notice
Please note that the content of your notice is required by law (and not something we came up with to complicate your life): (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright; (ii) a description of the copyrighted work that you claim has been infringed; (iii) the URL of the location on our website containing the material that you claim is infringing; (iv) your address, telephone number, and email address; (v) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf

Other legal matters
Termination
This Agreement will terminate if: (a) we believe that you have violated, or may violate, this Agreement or applicable law; (b) if we do not continue to provide all or relevant parts of the Site; and/or (c) if required by law. Even if the Agreement terminates, certain provisions will continue to survive. We can also suspend your access to this Site for no reason.
Third Parties
This Agreement does not give rights to any third parties.
Severability
If any aspect of this Agreement is unenforceable, the rest will remain in effect.
Amendment or Waiver
Any amendment or waiver to this Agreement must be in writing and it must be signed or posted by us. An email from us does not constitute an amendment. If you disagree with the new terms, then you must stop using the Site. If we fail to enforce any aspect of this Agreement, it does not mean that we are granting you a waiver. Any waiver must be in writing and signed by an authorized officer of Yosemite Consulting, with the writing expressly stating that given terms of this Agreement are being waived.
Reservation of Rights
We reserve all rights not expressly granted to you.
Assignment
You cannot transfer your rights or obligations under this Agreement unless we consent to it in writing signed by an authorized officer and such consent is provided in advance of your proposed transfer. We can assign our rights and obligations to others—for example, third parties might help us maintain the site or our contact database. In addition, assignment might occur if ownership of the Site changes.
